Canal Winchester has authority under Ohio Issue 2 and ORC 3780 to prohibit or limit adult-use cannabis dispensaries within city limits. Many central Ohio municipalities have enacted moratoriums or outright bans on new adult-use retail.
While Issue 2 legalized adult-use cannabis statewide, it preserved local authority to prohibit or limit adult-use dispensaries (not medical). Canal Winchester Council, like many smaller central Ohio cities, has considered or enacted zoning restrictions, moratoriums, or outright bans on adult-use retail. Medical marijuana dispensaries under the pre-existing Ohio Medical Marijuana Control Program are separately regulated and typically require conditional use approval with buffer zones (500 feet from schools, churches, parks, libraries, playgrounds, and child day-care centers) per state rules. Cultivation, processing, and testing facilities have similar siting restrictions. Current dispensary locations are concentrated in Columbus, Pickerington, and Lancaster rather than Canal Winchester proper.
Operating a dispensary without proper state license and local zoning approval: criminal trafficking charges under ORC 3780 and 2925; state license revocation; civil forfeiture. Unauthorized retail subject to closure.
