Ohio voters approved Issue 2 in November 2023, enacting ORC Chapter 3780 (Division of Cannabis Control). Adults 21+ may possess up to 2.5 ounces of cannabis and 15 grams of extract, and may grow up to 6 plants per person (12 per household) for personal use. Cultivation must be in a secured, enclosed space not visible to the public. Cannabis may not be smoked in public. Canal Winchester retains home-rule authority to regulate nuisance aspects (odor, smoke traveling to neighbors) under general nuisance law but cannot ban cultivation outright. Landlords may prohibit cultivation in leased properties. HOA covenants may restrict.
Over plant limit or public visibility: minor misdemeanor and potential forfeiture of excess. Smoking in public: $100-$150 civil penalty under Issue 2. Combined with DUI or child endangerment: serious charges.
