Ohio Issue 2 (effective December 2023) permits adults 21 and over to cultivate up to 6 cannabis plants per person, maximum 12 per household, for personal use. Pickerington cannot ban home cultivation but may regulate odor and nuisance impacts.
Under ORC 3780 et seq, home grows must occur in a secured, enclosed area not visible to the public. Plants cannot be visible from neighboring properties or public rights-of-way. Pickerington nuisance and odor provisions under Codified Ordinance 509.08 still apply. Landlords may prohibit cultivation in leased premises. Pickerington is not near a federally reserved military base that would preempt these rights.
Exceeding the 6/12 plant cap is a minor misdemeanor under ORC 3780.36. Visible plants or odor nuisance can draw a 150 dollar citation plus abatement order.
