Cannabis dispensary siting is a municipal decision, not a county one. Under N.J.S.A. 24:6I-45 each Atlantic County town may govern the number, location, and hours of cannabis establishments or prohibit one or more classes outright, on top of state licensing by the Cannabis Regulatory Commission.
Recreational cannabis businesses are licensed by the New Jersey Cannabis Regulatory Commission, but where they may operate is set by the municipality under N.J.S.A. 24:6I-45. A town may adopt ordinances governing the number of cannabis establishments and their location, manner, and times of operation, and may prohibit any one or more of the six license classes entirely. Municipalities that did not enact a prohibition within 180 days of the law's effective date allowed such uses by default for a five-year window. Atlantic County communities split: Atlantic City opted in and hosts adult-use retail dispensaries in mapped zones, while several shore and Pinelands towns, including Margate and Ventnor, prohibited one or more classes. The county has no role in siting.
A cannabis establishment operating outside a municipality's zoning ordinance, without local approval, or in a town that prohibited its class, faces license denial or revocation by the Cannabis Regulatory Commission and local enforcement.
