Jefferson County, AL Cannabis Regulations: Dispensary Zoning (2026)

The Alabama Compassion Act (Ala. Code §20-2A-1 et seq.) creates a licensed medical cannabis dispensary system with strict regulations. Dispensaries require Alabama Medical Cannabis Commission (AMCC) licenses, and cities may opt out of dispensary siting by ordinance under §20-2A-55. Buffer zones typically require 1,000 feet from schools, childcare centers, and churches. Jefferson County has Home Rule authority allowing unincorporated-area regulation separate from incorporated cities. Birmingham has not yet opted out and may permit dispensaries in commercial zones; several Birmingham City Council members have expressed support subject to specific zoning conditions. Hoover, Vestavia Hills, Mountain Brook, and Homewood have considered opt-out ordinances reflecting more conservative suburban positions. AMCC license awards have been contested in court since 2023 with multiple rounds of litigation before the Alabama Supreme Court and Montgomery Circuit Court delaying actual dispensary operations. As of late 2025, no dispensaries were operating in Jefferson County. Recreational cannabis retail remains entirely illegal - any unlicensed cannabis sales operation faces felony trafficking charges under Ala. Code §13A-12-231 with property forfeiture under §20-2-93. CBD products derived from hemp (under 0.3% THC) are sold legally through regular retail channels including gas stations, convenience stores, and specialty shops throughout the Birmingham metro.
