NY MRTA allowed municipalities to opt out of retail dispensaries and on-site consumption by December 31, 2021. Utica and Rome opted in; several Oneida County towns opted out. Opt-outs are subject to permissive referendum.
Under NY Cannabis Law Β§131, cities, towns, and villages could pass local law by 12/31/2021 to prohibit adult-use retail dispensaries and/or on-site consumption sites. Municipalities that opted out may opt back in at any time. Those that did not opt out cannot later ban. Oneida County towns that opted out include New Hartford, Whitestown, and Kirkland (per public records). Dispensaries must comply with Office of Cannabis Management (OCM) siting rules: 500 ft from schools, 200 ft from houses of worship.
