Florida Statute Β§381.986 (Medical Marijuana Act) prohibits ALL home cultivation of cannabis, even for registered medical patients. Medical marijuana must be purchased from state-licensed Medical Marijuana Treatment Centers (MMTCs) only. Brevard County has MMTCs in Melbourne, Cocoa, Palm Bay, and Viera. Recreational cannabis remains illegal in Florida - Amendment 3 (2024) failed to pass the 60% supermajority (59.4% in favor was insufficient). Possession of cannabis plants, seeds, or equipment for cultivation is a felony under FL Β§893.13 (Controlled Substances Act). Medical cards from other states not recognized. Home grows, even for small personal amounts, can result in felony cultivation charges regardless of patient status.
