Possession of 30 grams or less is a Class B misdemeanor; over 30 grams is a Class A misdemeanor or Level 6 felony depending on circumstances. The only cannabis-related exception is low-THC CBD under Senate Bill 52 (2018), which legalized CBD products containing 0.3 percent THC or less for retail sale in Indiana. Federal farm bill hemp (below 0.3 percent THC) is separately legal. Delta-8 THC exists in a legal gray area in Indiana with enforcement varying. Indiana borders Illinois and Michigan where recreational marijuana is legal, but importing into Indiana remains a crime. Fort Wayne Police enforce state law. Any Fort Wayne city measure does not override the state prohibition.
