Georgia prohibits all home cannabis cultivation. The state's Low THC Oil Registry (Haleon's Hope Act / O.C.G.A. Β§16-12-190 et seq.) allows qualifying patients to possess up to 20 fluid ounces of low-THC oil (0.3 to 5% THC) but does NOT permit cultivation, smoking, or edibles. Recreational marijuana remains illegal. Any cannabis plants on private property in DeKalb are subject to seizure and criminal charges. Possession of less than 1 ounce of marijuana is a misdemeanor under O.C.G.A. Β§16-13-2; cultivation/manufacturing of marijuana is a felony under O.C.G.A. Β§16-13-30(j). City of Atlanta (portions of which are in DeKalb) has reduced penalties for personal possession to a $75 fine, but cultivation remains a state felony.
