N.J.S.A. 2C:35-5 continues to criminalize manufacturing (growing) cannabis outside the licensed commercial system. Medical cannabis patients under the NJ Compassionate Use Medical Marijuana Act (N.J.S.A. 24:6I-1 et seq.) similarly cannot grow at home. This applies uniformly in Ocean County — Toms River, Brick, Jackson, Lakewood, Manchester, and LBI boroughs all enforce the state prohibition. Penalties for home cultivation: 1-5 plants is a fourth-degree crime (up to 18 months prison, $10,000 fine); 6-10 plants third-degree (3-5 years, $25,000); 10+ plants second-degree (5-10 years, $150,000). Cannabis must be obtained only from NJ-licensed dispensaries — nearest Ocean County dispensaries include several licensed adult-use retailers. NJ legislative efforts to legalize home grow have been introduced but none have passed as of 2025.
