Home cannabis cultivation is PROHIBITED in New Jersey under the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (N.J.S.A. 24:6I-31 et seq.). Adults 21+ may possess up to 6 oz but may not grow any plants at home. This applies in Ocean County regardless of municipality. Only licensed commercial cultivators may grow cannabis. Medical cannabis patients are also prohibited from home cultivation.
Unlike most states that legalized recreational cannabis, New Jersey maintains a strict prohibition on home cultivation. The Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMM Act, N.J.S.A. 24:6I-31 et seq., signed 2021) legalized adult possession of up to 6 ounces and established a regulated commercial marketplace, but explicitly prohibits personal cultivation. This applies uniformly in Ocean County β Toms River, Brick, Jackson, Lakewood, Manchester, and LBI boroughs all enforce the state prohibition. Penalties for home cultivation: 1-5 plants is a fourth-degree crime (up to 18 months prison, $10,000 fine); 6-10 plants third-degree (3-5 years, $25,000); 10+ plants second-degree (5-10 years, $150,000). Cannabis must be obtained only from NJ-licensed dispensaries β nearest Ocean County dispensaries include several licensed adult-use retailers. NJ legislative efforts to legalize home grow have been introduced but none have passed as of 2025.
