Kentucky prohibits home cannabis cultivation. KRS Β§218A.1422 criminalizes marijuana possession. Medical cannabis (KRS Β§218B, effective 2025) is processed-products only - no home grow. Recreational cannabis remains illegal statewide.
Kentucky prohibits all home cannabis cultivation under KRS Ch. 218A (Controlled Substances). Possession of any marijuana plant or cultivation materials constitutes marijuana cultivation under KRS Β§218A.1423, ranging from Class A misdemeanor (under 5 plants) to Class D felony (5 or more plants). The Medical Cannabis Program authorized by SB 47 (2023) under KRS Ch. 218B took effect January 1, 2025 and permits qualifying patients to purchase processed cannabis products from licensed dispensaries but does NOT authorize home cultivation - Kentucky is explicitly a processed-products-only medical state. Recreational cannabis remains fully illegal under state law. Louisville Metro has no authority to legalize cultivation. Industrial hemp with under 0.3% THC is legal under KRS Β§260.850 but requires a Kentucky Department of Agriculture hemp license for cultivation. LMPD enforces state drug laws and Louisville Metro has not decriminalized possession beyond a 2019 LMPD policy deprioritizing small-amount misdemeanor arrests.
Cultivation under 5 plants: Class A misdemeanor up to 12 months jail and $500 fine under KRS Β§218A.1423. 5+ plants: Class D felony 1-5 years prison and up to $10,000 fine. Medical patients cultivating: same penalties as non-patients. Property forfeiture possible under KRS Ch. 218A.
