Home cannabis cultivation is illegal in Mecklenburg County. North Carolina has not legalized medical or recreational marijuana; cultivation of any amount is a felony under N.C.G.S. §90-95. Only low-THC hemp (under 0.3% delta-9 THC) is legal under federal and state law.
North Carolina law prohibits cultivation of marijuana regardless of purpose. Federally-legal hemp (below 0.3% delta-9 THC) can be grown with a NCDA Hemp License under N.C.G.S. §106-568.50. Charlotte and Mecklenburg County have no local cultivation ordinance because state law preempts.
