HOAs in Mecklenburg County may impose fines up to 100 dollars per violation per day under NCGS 47F-3-107.1 after a hearing before an adjudicatory panel of uninterested owners. Owner entitled to 10 days written notice.
The Planned Community Act requires a formal due-process hearing before fines are imposed. The panel must be appointed by the board from owners not on the board. Owner receives notice stating the specific violation, date, and right to be heard. After hearing, the panel must issue a written decision. Continuing violations accrue at up to 100 dollars per day. Unpaid fines become part of the lien under 47F-3-116. Self-help remedies (e.g. entering property to remove unauthorized items) are generally not authorized unless the declaration explicitly provides.
