Only ground-based sparkling devices (sparklers, fountains, snakes, smoke) are legal in Mecklenburg County under NCGS 14-414. All aerial fireworks, firecrackers, bottle rockets, and Roman candles are illegal. The County Fire Marshal and Charlotte-Mecklenburg Police enforce violations.
North Carolina General Statute 14-414 classifies aerial and explosive fireworks as pyrotechnics that may only be discharged by licensed operators with a permit. Consumer-legal devices are limited to non-aerial, non-explosive sparkling devices that do not leave the ground, do not explode, and do not contain more than 200 grams of pyrotechnic composition. Mecklenburg County cannot expand what state law allows. The NC State Fire Marshal licenses commercial display operators. During drought or elevated fire danger, the County Fire Marshal may restrict even legal sparkling devices.
Possession or use of illegal fireworks is a Class 2 misdemeanor under NCGS 14-410 carrying up to 60 days jail and a fine at the court's discretion. Selling illegal fireworks can be charged as a Class 1 misdemeanor.
