The North Carolina State Building Code requires smoke detectors in every sleeping room, outside each sleeping area, and on every floor of dwellings in Mecklenburg County. New construction requires hardwired, interconnected detectors with battery backup.
The NC Residential Code Section R314 (adopted under NCGS 143-138) requires smoke alarms in each bedroom, outside each sleeping area, and on each additional story including basements. For new construction and substantial renovation, detectors must be hardwired, interconnected, and equipped with battery backup. Existing homes at time of sale or major alteration must comply. Mecklenburg County Code Enforcement and Charlotte Fire Department inspect rental units for compliance with NCGS 42-42 (landlord duty to provide operable smoke detectors). Carbon monoxide alarms are required near sleeping areas where fuel-fired appliances or attached garages exist.
Landlords who fail to provide operable smoke detectors can face civil penalties under the NC Residential Rental Agreements Act and tenant remedies including rent abatement.
