NC State Building Code requires working smoke alarms in every bedroom, outside sleeping areas and on every level. Rental units must have operational smoke alarms at the start of each tenancy under N.C.G.S. ยง42-42.
The NC State Residential Code (based on the IRC) requires smoke alarms in all new and renovated dwellings: inside each bedroom, outside each sleeping area, and on every story including basements. Alarms must be interconnected and hardwired with battery backup in new construction. N.C.G.S. ยง42-42(a)(5) requires landlords to provide operational smoke alarms at the start of each tenancy and to replace batteries at the beginning of a tenancy. Carbon monoxide alarms are required in dwellings with fuel-fired appliances or attached garages. Huntersville Fire Department offers free smoke alarm installation for qualifying residents through its community risk reduction program.
Landlord failure to provide working alarms is a violation of NC Residential Rental Agreements Act. Building code violations may trigger stop-work orders on construction projects.
