Mecklenburg County does not impose a statewide-style defensible space rule, but the county Nuisance Ordinance requires property owners to keep lots clear of excessive dry brush, weeds, and combustible debris that create fire hazards. Code Enforcement issues notices to abate.
Mecklenburg County Code of Ordinances Chapter 6 (Nuisances) and Chapter 10 (Minimum Housing) authorize the county to declare overgrown or debris-laden lots a public nuisance. Property owners must maintain vegetation and remove dead trees or limbs that threaten structures. In unincorporated areas, Charlotte Fire Department and the County Fire Marshal may require additional clearance around structures following wildfire warnings issued by the NC Forest Service. The Catawba-Wateree watershed and urban-wildland interface zones near Latta and McDowell Nature Preserves receive closer scrutiny.
Failure to abate a nuisance can result in the county performing the work and assessing costs as a lien on the property plus a civil penalty typically $100-$500 per violation.
