All residential swimming pools in unincorporated Mecklenburg County must be enclosed by a barrier at least 48 inches high with self-closing and self-latching gates under NC State Building Code Appendix G. Gaps may not exceed 4 inches and latches must be 54 inches above grade.
Pool barrier requirements apply to in-ground, above-ground, and permanent spas with water depth exceeding 24 inches. Mecklenburg County Code Enforcement inspects pool barriers at final permit closeout. Federal Virginia Graeme Baker Act drain-cover compliance also required. Contact Mecklenburg County at (704) 336-7600 for enforcement.
No final pool permit without compliant barrier. Non-compliance on existing pool: 250 dollars per day civil penalty plus possible closure order.
