Illinois law prohibits recreational home cultivation of cannabis. Only registered medical cannabis patients may cultivate up to 5 plants at home under the Cannabis Regulation and Tax Act (410 ILCS 705). Oak Lawn follows state law and does not permit recreational home grows.
Under Illinois's Cannabis Regulation and Tax Act (CRTA), recreational adult-use cannabis is legal for possession but home cultivation is limited to registered medical cannabis patients. Medical patients may cultivate up to 5 plants over 5 inches tall. Recreational home growing by non-patients is illegal and remains a state-level offense. Medical home cultivation must be conducted in an enclosed, locked space not visible to the public, and not accessible to anyone under 21. Plants may not be in yards, balconies, or windows visible from public view. Products must be secured from children and pets. Landlords may prohibit cultivation on rental properties even by registered patients. Oak Lawn does not provide any local allowance for recreational home cultivation. Residents who are medical cannabis cardholders should check with their landlord if renting and consider home security for their cultivation area. Possession limits for recreational users: Illinois residents may possess 30 grams of flower, 5 grams of concentrate, and 500 mg THC in infused products.
Unauthorized cannabis cultivation is a state crime under Illinois law. Possession of more than 5 plants or cultivation without medical registration can result in felony charges. Oak Lawn Police enforce alongside state law enforcement.
