Under the Illinois Cannabis Regulation and Tax Act (410 ILCS 705), only registered medical cannabis patients may cultivate cannabis at home, limited to five plants. Recreational home cultivation is prohibited statewide. Orland Park has no separate Village ordinance authorizing additional home cultivation.
The Illinois Cannabis Regulation and Tax Act (CRTA) legalized adult-use recreational cannabis in 2020 but expressly prohibits recreational home cultivation. Only registered patients of the Illinois Medical Cannabis Pilot Program may cultivate cannabis at home. Medical patients are limited to five plants taller than 5 inches and the plants must be grown in an enclosed, locked space at the patient's primary residence and out of public view. Plants may not be visible from any other lot or public way. Cultivation in a residence with a child requires that the area be locked. Patients may not sell or distribute the cannabis they grow. Recreational adult-use cannabis must be purchased from a licensed dispensary. Orland Park has not adopted a separate Village ordinance authorizing additional home cultivation rights, and any home cultivation must comply with state law. Landlords may prohibit cannabis cultivation in rental units. Smoking cannabis is prohibited in common areas of multi-family buildings and within 1,000 feet of a school under state law.
Recreational home cultivation in Orland Park violates state law and is subject to state penalties (typically a civil violation for small numbers of plants but potentially criminal for larger operations). Medical cultivation in violation of patient rules may result in loss of medical cannabis card and state penalties. Contact Orland Park Police at (708) 349-4111 for cannabis enforcement.
