Under the Illinois Cannabis Regulation and Tax Act (410 ILCS 705), recreational adult-use home cultivation is NOT permitted in Illinois. Only registered medical cannabis patients may grow up to 5 plants at home, in an enclosed, locked space not visible to the public, on property they own or with landlord consent. Illinois's Cannabis Regulation and Tax Act, which took effect January 1, 2020, does NOT authorize home cultivation for recreational adult use. Cultivation must occur in an enclosed, locked space not accessible to anyone under 21 and not visible from a public place. Renters need landlord permission. All cultivation equipment must be secured. Registered patients may possess the cannabis produced from those plants exclusive of the statewide possession limits. Skokie's municipal code does not further regulate or permit home cultivation beyond state law. Non-medical home growing is a violation of state law and subject to state penalties; Skokie police may refer cases to the Cook County State's Attorney. Odor from medical cultivation should not create a nuisance; Village property maintenance and nuisance rules can apply.
Non-medical home cultivation is unlawful under Illinois state law. Penalties escalate with plant count, potentially including misdemeanor or felony charges. Unauthorized cultivation also creates federal law complications. Medical cultivation that creates a neighborhood nuisance (odor, visibility) may result in Village property maintenance enforcement in addition to state penalties.
