Home cultivation of cannabis is illegal throughout Allegheny County. Pennsylvania Medical Marijuana Act (Act 16 of 2016, 35 P.S. 10231.101) does not permit patient home grow. Recreational cannabis remains illegal statewide. Pittsburgh decriminalized small possession but cannot authorize cultivation.
PA Act 16 of 2016 legalized medical cannabis but prohibits home cultivation by patients; only licensed growers/processors may cultivate (35 P.S. 10231.601-603). Growing any cannabis plant is a violation of the Controlled Substance, Drug, Device and Cosmetic Act (35 P.S. 780-113). Pittsburgh Code 601.05 reduces penalty for possession of small amounts but does not authorize cultivation. Any number of plants can be charged as manufacturing.
Manufacturing cannabis under 35 P.S. 780-113(a)(30): ungraded felony, up to 5 years jail and 15000 dollars fine for first offense; cultivation of 10-50 plants up to 10 years and 100000 dollars. Federal Schedule I charges possible. Property forfeiture possible under PA Controlled Substances Forfeiture Act.
