San Bernardino County, CA Cannabis Regulations: Home Cultivation (2026)

Cannabis cultivation in unincorporated San Bernardino County is governed by Title 8, Division 4, Chapter 84.34 of the County Development Code. Section 84.34.040 exempts personal cultivation from the commercial cannabis prohibition only if it occurs entirely indoors. State law sets the baseline: California Proposition 64, codified at Health and Safety Code Section 11362.1, allows persons 21 or older to possess and cultivate up to six living cannabis plants per private residence; medical patients with a state identification card may cultivate up to 12 plants for personal medical use, with an aggregate maximum of 24 plants per residence when more than one cardholder or primary caregiver lives there (HSC 11362.77). Section 84.34.040 further requires that the cultivation occur within a fully enclosed structure with solid walls and a ceiling or roof, in one distinct designated cultivation area separately secured and locked from all other uses, with all plants reasonably secured from theft and access by minors, and with no cannabis perceptible from the exterior.
