California Proposition 64 (Adult Use of Marijuana Act), codified at Health and Safety Code 11362.1 and 11362.2, allows any adult 21 or older to cultivate up to 6 living cannabis plants for personal use inside their private residence. Proposition 64 allows cities to prohibit outdoor cultivation, and Ontario has exercised that authority: Ontario Municipal Code Chapter 9 prohibits all outdoor personal cannabis cultivation within the city limits. Indoor cultivation must occur inside a secure, locked, fully enclosed area that is not visible from a public place or from any place a minor could reasonably access. Lighting must meet the California Electrical Code with GFCI protection, grow rooms must meet building code ventilation standards, and odor cannot create a public nuisance under OMC Chapter 30. Landlords may prohibit cultivation in lease agreements under Civil Code 1947.5. Growing more than 6 plants, any commercial cultivation, or any outdoor cultivation in Ontario remains illegal and can trigger citation, abatement, and potential criminal charges under Health and Safety Code 11358.
