Sunnyvale residents 21 and over may cultivate up to six cannabis plants indoors at their primary residence under Proposition 64, but outdoor cultivation is banned.
Under California Proposition 64 (Adult Use of Marijuana Act, 2016) and the Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA), adults 21 and over may cultivate up to six cannabis plants for personal use at their primary residence. Sunnyvale Municipal Code regulates personal cultivation consistent with state law but prohibits outdoor cultivation on residential property. Indoor cultivation must occur inside a private residence or a fully enclosed and secure structure that is not visible from public places. Cultivation areas must comply with building, electrical, and fire safety codes. Plants and cannabis must be kept out of reach of minors and not accessible from the outside. Renters should note that landlords may prohibit cannabis cultivation in lease agreements. Exceeding the six-plant limit or cultivating for sale without state licensing violates both local and state law and can result in misdemeanor or felony charges.
