New York adults aged 21 and over may grow a limited number of cannabis plants at home statewide, including in Nassau County, regardless of the county opt-out from retail sales.
Under NY Cannabis Law, residents 21 and over may cultivate up to three mature and three immature cannabis plants per person, with a household maximum of six mature and six immature plants regardless of how many adults live there. Plants must be grown in a secure location not visible to the public and not accessible to anyone under 21. Nassau County's 2022 opt-out from adult-use retail dispensaries does not affect personal home cultivation, which is a state-level right that towns and villages cannot prohibit but may regulate for safety.
Exceeding plant limits, public visibility, or providing access to minors can lead to civil penalties and, for larger grows, criminal prosecution under state law.
