Under LA RS 40:966 and the medical marijuana program established by LA RS 40:1046, only contracted growers (LSU and Southern University AgCenter) and licensed producers may cultivate marijuana. Patients receive product through the nine state-licensed pharmacies and may not grow plants at home regardless of medical status. New Orleans City Ordinance 19-191 reduced first-offense possession to a $40 civil fine but did not authorize cultivation, and state cultivation penalties remain in effect within the city. Industrial hemp under LA RS 3:1461 is regulated separately and is not the same as marijuana.
Unlicensed cultivation can be charged under LA RS 40:966 as a felony depending on plant count, with potential incarceration. NOLA Ord. 19-191's civil fine applies only to small possession, not cultivation.
