NJ Β§24:6I (Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act, 2021) legalized adult possession but left home cultivation a criminal offense under NJ Β§2C:35-5. Cultivating any amount remains a third-degree felony for one to five plants and second-degree for more. Newark has no authority to override this state preemption. Medical cannabis patients also cannot home-grow under current law, despite multiple legislative attempts to amend Β§24:6I. Enforcement is by Newark Police plus state authorities. This is among the strictest personal-cultivation rules in any US legalization state.
Home cultivation is a third-degree crime (one to five plants) carrying three to five years prison, up to $25,000 fine, plus federal exposure. Newark Police actively enforce alongside CRC referrals.
