Adopted in 2017 under Oakland Municipal Code Title 5 Chapter 5.80 and 5.81, the Equity Permit Program issues at least half of new cannabis business permits to equity applicants, defined as Oakland residents with low income who either had a past Oakland cannabis conviction or lived for years in police-beat areas with disproportionate drug enforcement. Equity permittees receive priority processing, fee deferrals, and access to incubator partnerships in which a general applicant provides rent-free space and technical support in exchange for a parallel license. The Department of Cannabis Regulatory Commission administers the program.
Falsifying equity eligibility, failing to honor an incubator agreement, or operating outside the permit's scope can lead to license revocation, civil penalties, and disqualification from future cannabis permits.
