Recreational drone operation in Colonie is regulated primarily by the Federal Aviation Administration under the FAA Reauthorization Act of 2018 (49 U.S.C. §44809) and FAA Part 107 (commercial). Federal law substantially preempts the airspace, so the Town of Colonie does not - and cannot - regulate the flight itself. Colonie's special challenge is its location: most of the Town sits under or adjacent to the Class C airspace surrounding Albany International Airport, where recreational drone flight requires LAANC authorization through B4UFLY or a DroneZone request. Local takeoff/landing on Town-owned property requires Town consent.
