Recreational drone operation in Colonie is regulated primarily by the Federal Aviation Administration under the FAA Reauthorization Act of 2018 (49 U.S.C. Β§44809) and FAA Part 107 (commercial). Federal law substantially preempts the airspace, so the Town of Colonie does not - and cannot - regulate the flight itself. Colonie's special challenge is its location: most of the Town sits under or adjacent to the Class C airspace surrounding Albany International Airport, where recreational drone flight requires LAANC authorization through B4UFLY or a DroneZone request. Local takeoff/landing on Town-owned property requires Town consent.
Federal preemption of drone airspace is broad. 49 U.S.C. Β§44809 (Exception for Limited Recreational Operations) requires recreational drone pilots to (a) operate within visual line of sight; (b) fly below 400 feet AGL in uncontrolled (Class G) airspace and obtain prior authorization in controlled airspace; (c) yield right-of-way to manned aircraft; (d) register the drone with the FAA if it weighs more than 0.55 pounds; (e) pass the TRUST recreational pilot test; and (f) follow the safety guidelines of an FAA-recognized community-based organization (CBO). For Colonie residents the controlling fact is that nearly all of the Town - and especially the dense residential neighborhoods along Central Avenue (NY Route 5), Loudonville, Latham, Newtonville, Boght, and the Wolf Road / Crossgates corridor - lies under or adjacent to the Class C airspace ringing Albany International Airport (ALB), with airspace floors as low as the surface within the inner ring and 1,200-1,800 feet within the outer ring. Recreational drone flight anywhere inside that footprint requires LAANC airspace authorization through the FAA's B4UFLY app (preferred) or a DroneZone request. The Town of Colonie's home-rule authority does not extend to regulating the airspace itself, and the U.S. District Court for the District of Massachusetts decision in Singer v. City of Newton, 284 F.Supp.3d 125 (D. Mass. 2017) and FAA Advisory Circular 91-57B make clear that municipal airspace-flight bans are preempted. What Colonie may regulate is takeoff and landing from Town-owned property: Town parks (including the Mohawk River Park, the Mohawk-Hudson Bike-Hike Trail, Cook Park, and others), Town beaches, Town parking lots, and Town buildings. Use of Town parks for drone takeoff/landing typically requires advance permission from the Colonie Parks and Recreation Department under the general park-use rules. Privacy violations (peeping, harassment, recording in a private setting) remain prosecutable under NY Penal Law Β§250.45 (unlawful surveillance) regardless of the drone's altitude or airspace status. Operators within 5 miles of any heliport or other airport (Schenectady County Airport to the west, helipads at Albany Medical Center and the New York State Office Campus) must obtain LAANC authorization for those facilities as well.
Federal: Operating without LAANC authorization in Albany ALB Class C airspace violates 14 CFR Part 107 (commercial) or 49 U.S.C. Β§44809 (recreational) and exposes the operator to FAA civil penalties up to $32,666 per violation (current ceiling), certificate suspension, and criminal referral for willful airspace violations. Failure to register the drone with the FAA is a separate civil violation under 49 U.S.C. Β§44103. State: NY Penal Law Β§250.45 (unlawful surveillance) makes it a Class E felony to use a drone (or any imaging device) to view or record another person in a place where the subject has a reasonable expectation of privacy. Local: Using a Town park for drone takeoff/landing without Parks Department consent is a Town Code violation enforceable in Colonie Town Court. Operating within Albany County Sheriff or local-police visual range during an emergency or near a public-safety scene can be prosecuted under N.Y. Penal Law Β§195.05 (obstructing governmental administration) where the drone interferes with first-responder operations.
