NYC Admin Code Β§10-126(c) effectively bans recreational drone flying in the city by prohibiting takeoff and landing of aircraft (including drones) from any location other than designated facilities. FAA Class B airspace covers all five boroughs, requiring LAANC authorization. Limited flying is permitted in designated parks with Parks Department approval.
NYC is one of the most restrictive cities in the US for recreational drones. Admin Code Β§10-126(c) prohibits the takeoff, landing, or operation of any aircraft β including unmanned aircraft systems (drones) β from any location in NYC other than areas designated for such use. All five boroughs fall within FAA Class B airspace (controlled by JFK, LaGuardia, and Newark approach), requiring authorization through LAANC (Low Altitude Authorization and Notification Capability) even if a legal launch site is found. NYC Parks Rules prohibit drone operations in parks unless specifically authorized. As of recent policy, Parks has designated limited areas in certain parks for recreational drone flying by permit β primarily larger parks outside of Manhattan. Federal FAA Part 107 rules (for commercial) and Part 44809 (for recreational) apply in addition to local restrictions. Recreational pilots must pass the TRUST (The Recreational UAS Safety Test) and register their drone with the FAA. The NYPD can confiscate drones operated illegally.
Operating a drone in violation of Β§10-126(c): criminal misdemeanor, up to $200 fine or 6 months jail. Flying in parks without authorization: Parks Rules violation, $50β$250. FAA violations for unauthorized Class B operations: federal penalties up to $20,000.
