Apex, NC

Apex does not impose a citywide overnight parking ban on passenger vehicles. The functional limits on overnight parking are NCGS 20-162 distance restrictions (15 feet from a fire hydrant or fire station entrance, in front of a private driveway, 25 feet from a curb-line intersection), any posted no-parking signs established by Board ordinance through the Apex Traffic Engineering process, and the downtown Monday-Friday 9 a.m. to 5 p.m. time-limit zones (2 hr or 3 hr). UDO Section 8.3.4 prohibits off-street parking or storage of vehicles, travel trailers, or motor homes within any front or street side setback area except in the driveway access portion. NCGS 20-137.7 defines an abandoned vehicle as one that has remained illegally for more than 10 days without consent.

Apex FAQ
Is overnight parking legal on Apex streets?
Yes for passenger vehicles. Apex does not impose a citywide overnight street parking ban on cars and light trucks. The functional limits are posted no-parking ordinances adopted by the Board of Commissioners under Chapter 20 of the Apex Code of Ordinances, the downtown Monday-Friday 9 a.m. to 5 p.m. time-limit zones (which are not enforced overnight or on weekends/holidays), and the state-law distance restrictions in NCGS 20-162(a): 'No person shall park a vehicle or permit it to stand, whether attended or unattended, upon a highway in front of a private driveway or within 15 feet in either direction of a fire hydrant or the entrance to a fire station, nor within 25 feet from the intersection of curb lines.' A vehicle that has remained on the street for more than 10 days without consent may be processed as an abandoned vehicle under NCGS 20-137.7 and Apex Chapter 20, Article III. HOA covenants in most Apex subdivisions impose additional, often stricter overnight parking restrictions on private streets and driveways, enforced privately by the HOA.
Can I sleep in my RV overnight in front of my Apex house?
There is no Apex-specific habitation-in-vehicle ban on the public street, but UDO Section 8.3.4 (Setbacks) restricts off-street RV storage on the residential lot itself: 'Off-street parking or storage of vehicles, travel trailers, or motor homes shall not be permitted within any front or street side setback area, provided that off-street parking may be permitted within that portion of any setback used for driveway access to required off-street parking areas. Storage of mobile homes is not permitted.' On the street, NCGS 20-162 still applies (no parking in front of a private driveway, within 15 feet of a fire hydrant or fire station entrance, or within 25 feet of a curb-line intersection). HOA covenants in most Apex subdivisions go further and prohibit visible RV storage and overnight RV stays on driveways or streets within the community. After 10 days, the vehicle may be processed as abandoned under NCGS 20-137.7.
Cary FAQ
Is overnight street parking legal in front of my Wake County home?
Yes, on NCDOT roads in unincorporated areas as long as you do not block travel lanes (NCGS §20-161). Inside towns, check for posted permit-parking or no-parking signs first.
How long can a guest's car sit on the street?
Up to 7 days on a public road before NCGS §153A-132(b)(1)(d) treats it as abandoned. Residential permit zones in Raleigh can shorten that to 2 or 24 hours by signage.
Are there overnight rules in commercial parking lots?
Each lot owner sets the rules; under NCGS §20-219.2 a private lot owner with proper signage may tow unauthorized vehicles at the owner's expense.
