Occupancy Limits: Melbourne vs Titusville

How do occupancy limits rules compare between Melbourne, FL and Titusville, FL?

Melbourne has fewer restrictions than Titusville.

Melbourne, FL

Brevard County

Few Restrictions

The City of Melbourne has not adopted a vacation-rental-specific occupancy ordinance, and Florida Statute 509.032(7)(b) preempts the city from imposing STR-only guest caps unless one was on the books before June 1, 2011, which Melbourne did not have. Practical occupancy limits come from the Florida Building Code, the DBPR vacation rental dwelling license under F.S. 509.241, and Brevard County rules.

Titusville, FL

Brevard County

Heavy Restrictions

Titusville Land Development Regulations Chapter 28, Article I, Section 28-9 prohibits the rental of an entire single-family dwelling for periods of three months or less in residential and mixed-use districts. The 2007 ordinance pre-dates Florida Statute 509.032(7)(b)'s June 1, 2011 cutoff and is therefore grandfathered, making Titusville one of the few Florida cities that can lawfully restrict short-term whole-home rentals.
