Are coast live oaks protected in the City of Ventura?

Oaks on private property outside a federal critical habitat or Monarch overwintering site are not subject to a city heritage-oak ordinance. If the oak is in the Santa Clara River riparian zone, CDFW §1602 may apply. Unincorporated Ventura County has separate oak rules that do not apply inside city limits.

Can I trim a tree with a bird nest in it?

If the nest is active (has eggs or young), trimming is prohibited under the federal Migratory Bird Treaty Act and California Fish & Game Code §3503.5. Wait until nesting is complete, generally September through January, or hire a qualified biologist to confirm the nest is inactive.

What about Monarch overwintering eucalyptus on my property?

If your parcel overlaps a Monarch overwintering site mapped in 2050 General Plan Figure 23, the eucalyptus on it are protected under the Emergency Tree Protection Ordinance. Any trimming or removal requires a Planning Division permit and may require an arborist or biologist report.
