There is no statewide or countywide juvenile curfew in West Virginia, so a minor on unincorporated Kanawha County roads breaks no curfew law. The City of Charleston is the exception. Its Youth Protection Ordinance, upheld by a Kanawha County Circuit judge in 1999, makes it unlawful for anyone under 18 to remain in a public place or business from 10 p.m. to 6 a.m. Sunday through Thursday and from midnight to 6 a.m. Friday and Saturday. Standard exceptions cover a minor with a parent, traveling to or from work, or attending a school, religious, or civic event. Other Kanawha cities such as St. Albans may set their own hours.
Charleston police may take a curfew violator home or into protective custody and cite the parent. A parent or guardian who knowingly allows a violation commits a misdemeanor; repeat cases can reach juvenile court.
