Napa County Code Chapter 9.08 (Curfew for Minors) prohibits minors from being in or upon any public place in unincorporated Napa County during nighttime curfew hours unless accompanied by a parent or guardian or engaged in a specifically exempted activity. Violations are misdemeanors handled under California juvenile court law and procedure per Β§9.08.020.
Title 9 of the Napa County Code (Public Peace, Morals and Welfare) contains Chapter 9.08, the County's Curfew for Minors ordinance. Section 9.08.010 prohibits minors from being in or upon public places - including streets, highways, sidewalks, alleys, parks, playgrounds, parking lots, and other outdoor areas - during the County's nighttime curfew hours. The ordinance applies only in unincorporated Napa County; the cities of Napa, American Canyon, Yountville, St. Helena, and Calistoga regulate curfew through their own municipal codes. Standard California-style exceptions apply: minors accompanied by a parent or legal guardian, minors traveling directly to or from work, school, or organized activities, and minors responding to an emergency are not in violation. Section 9.08.020 makes violation a misdemeanor handled in juvenile court under California juvenile court law and procedure. Enforcement is by the Napa County Sheriff. Parents may also face civil or administrative consequences in cases of repeated curfew violations by their children.
Per Β§9.08.020, any minor violating Β§9.08.010 is guilty of a misdemeanor and shall be dealt with in accordance with juvenile court law and procedure. Minors stopped under the curfew may be released to a parent, transported to juvenile intake, or cited. Parents who knowingly permit curfew violations can be subject to additional enforcement.
