Rensselaer County has not enacted a countywide juvenile curfew, and the City of Troy's code does not include an enforceable general-purpose curfew for minors. Troy Police rely on NY Penal Law 240.35 (loitering) and parental-responsibility statutes when unsupervised minors create problems late at night. School-age truancy is enforced under NY Education Law 3213 through the Troy City School District attendance officer and Rensselaer County Probation Department. Minors transported to or from legitimate work, religious, school, or emergency activity, or accompanied by a parent or guardian, are not subject to any time-based restriction in the county.
No civil fine under county law. Parents of chronic truants may face Education Law 3233 prosecution (up to $10 first offense, $50 subsequent, or 10 days jail). Loitering violations under Penal Law 240.35 are non-criminal violations punishable by fine up to $250.
