FAA Part 107 and recreational rules (44809) preempt most drone regulation. NY State Parks prohibit drone takeoff/landing without permit. Broome County parks follow similar restriction; Binghamton has no specific drone ordinance.
Federal law governs drone operations in Broome County airspace. Under 14 CFR Part 107, commercial operators must hold a Remote Pilot Certificate; recreational operators must follow 49 USC Β§44809, including passing TRUST, flying only within visual line of sight, below 400 ft AGL, away from other aircraft, and not over people or moving vehicles. Registration with FAA is required for drones weighing 0.55 lb (250 g) or more. Remote ID broadcast is required for all drones registered for recreational use. The FAA preempts municipal regulation of airspace but localities may regulate takeoff, landing, and operator behavior on local land. NY State Parks (9 NYCRR Part 375) prohibit drone takeoff and landing in state parks and historic sites without a permit; Chenango Valley State Park and Oquaga Creek State Park near Broome are covered. Broome County Parks and the City of Binghamton Parks follow similar restriction on park property. SUNY Binghamton campus airspace is restricted under university policy. Greater Binghamton Airport (BGM) Class E airspace requires LAANC authorization for Part 107 flights.
FAA: Up to $32,666 civil penalty per recreational violation; higher for commercial. Criminal: up to $250,000 and 3 years for reckless operation endangering aircraft (18 USC). NY Parks drone violation: $250-$500.
