Minnehaha County has not adopted a county-level ordinance regulating recreational drone (Unmanned Aircraft System) operation. The county's published list of county ordinances contains 23 enactments (Zoning, Subdivision, Animal Control, Parks, Nuisance, Flood Plain, etc.) and does NOT include any UAS/drone ordinance. Recreational flights in the unincorporated portions of the county are therefore governed by federal FAA rules (49 U.S.C. 44809 — Exception for Limited Recreational Operations of Unmanned Aircraft) and by the limited state framework in SDCL Title 50, Chapter 13 (Aeronautics). South Dakota's drone-specific statutes principally regulate law-enforcement use rather than private recreational operation, and SDCL Chapter 50-13 does NOT contain a broad preemption of municipal or county drone regulation — meaning the county COULD adopt one but has chosen not to. Fly under FAA recreational rules: register the aircraft if it weighs more than 0.55 lb (250 g), pass The Recreational UAS Safety Test (TRUST), stay below 400 ft AGL, maintain visual line of sight, fly only in uncontrolled (Class G) airspace or obtain LAANC authorization for controlled airspace near Sioux Falls Regional Airport (FSD) and Joe Foss Field, and do not interfere with manned aircraft.
Sioux Falls Regional Airport / Joe Foss Field (FSD), located in the City of Sioux Falls within Minnehaha County, generates a substantial Class C / Class D controlled-airspace footprint that extends well into the unincorporated county. Recreational flights inside that controlled airspace require prior FAA authorization through the LAANC (Low Altitude Authorization and Notification Capability) system before takeoff — the county itself does not issue or deny these authorizations. Outside the controlled-airspace shelf, recreational flight in the agricultural and rural portions of unincorporated Minnehaha County is governed only by federal rules and general state law (trespass, harassment, peeping, voyeurism — see SDCL 22-21-1 invasion of privacy). The Minnehaha County Parks Ordinance ('Control, Regulation and Use of Parks') governs the county's three parks (Bucher Prairie, Perry Nature Area, Wall Lake) but does not expressly mention drones; users should treat the dawn-to-dusk operating hours and the prohibition on disturbing other visitors as the effective constraint. Within incorporated municipalities inside Minnehaha County (Sioux Falls, Brandon, Hartford, Dell Rapids, Crooks, Garretson, Humboldt, Valley Springs), the city's own ordinances and park rules apply rather than the county's — Sioux Falls in particular has additional municipal park-rule restrictions and the Class C airspace overlay.
There is no county-imposed penalty for recreational drone use in unincorporated Minnehaha County because no county UAS ordinance exists. Federal FAA enforcement applies — civil penalties under 14 CFR Part 107 / 49 U.S.C. 44809 can reach into the thousands of dollars per violation (operating without TRUST, unregistered aircraft over 250 g, controlled-airspace incursions, flying over 400 ft AGL, careless or reckless operation endangering manned aircraft). State-law overlays still apply: SDCL 22-21-1 (invasion of privacy) is a Class 1 misdemeanor; trespass on agricultural land (SDCL 22-35-6) is a Class 2 misdemeanor; flying a drone in a manner that distracts or harasses livestock could implicate SDCL 40-1-27 (livestock interference). Any law-enforcement use of UAS within the county is bound by SDCL Title 50 Chapter 13 warrant-style restrictions and is not a vehicle for private operators.
