Carlsbad complies with California's Unreinforced Masonry Building Law (Government Code 8875-8875.10) which required all jurisdictions in Seismic Zone 4 to identify URM buildings and adopt a mitigation program. Carlsbad has no separate municipal mandatory-retrofit ordinance for URMs or soft-story buildings; state-mandated standards apply through CBC Chapter 16 and the California Existing Building Code Appendix A.
Under California Government Code 8875.2, Carlsbad as a Seismic Zone 4 city was required to inventory unreinforced masonry buildings and establish a loss-reduction program. The Carlsbad Building Division enforces seismic retrofit standards through the California Building Code (Title 18 CMC) and California Existing Building Code (CEBC) Appendix Chapter A1, which provides the engineering standard for voluntary or mandatory URM retrofits. Unlike Los Angeles, San Francisco, or Long Beach, Carlsbad has NOT adopted a mandatory soft-story or URM retrofit ordinance, so retrofits are owner-initiated unless triggered by a substantial alteration permit under CBC 3403 (alterations affecting more than 50% of the building). New construction must meet current CBC seismic design provisions.
Failure to comply with seismic provisions when triggered by a building permit results in permit denial and stop-work orders. Performing structural alterations without a permit is a misdemeanor under CBC 113 carrying fines up to $1,000 and possible jail time. There are no civil penalties for failing to voluntarily retrofit an existing URM building in Carlsbad because no mandatory program exists.
