Florida voters passed Amendment 2 in 2020, locking minimum wage increases into Article X Section 24 of the state Constitution. The schedule reached $13 in 2024, $14 in 2025, and $15 on September 30, 2026. The 2026 rate from January 1 through September 30 is $14.84 due to the indexed mid-cycle calculation; afterward the constitutional $15 floor takes effect with annual CPI adjustments. Tipped workers receive $3.02 less per hour. Local governments including Miami-Dade and Miami Beach have attempted higher local minimum wages, but Florida Statute 218.077 preempts them. The county Living Wage covers only its contractors.
Workers may sue for unpaid wages plus liquidated damages and attorney fees under FL §448.110. Willful violations can trigger civil penalties up to $1,000 per offense from the state Attorney General.
