Richmond cannot set its own minimum wage above Virginia's statewide floor. The Virginia minimum wage rose to $12 per hour and is scheduled to reach $13.50 under recent General Assembly amendments to Title 40.1.
Under Dillon's Rule, Virginia cities may not establish minimum wages exceeding the state floor. The Virginia General Assembly raised the statewide minimum from $7.25 (federal) through $9.50, $11, and $12, with additional steps toward $13.50 enacted by amendments to Virginia Code Title 40.1, Chapter 3. Richmond businesses, including small retailers in Carytown, restaurants near VCU, and warehouses near the James River fall line, follow the state schedule. Tipped workers may receive a lower cash wage with tip credit. The General Assembly retains exclusive authority over wage policy.
