Virginia Code Section 4.1-1101 allows adults 21 and older to share up to one ounce of cannabis without remuneration, but explicitly prohibits gifting cannabis as part of any other transaction such as buying a sticker, t-shirt or admission ticket. Until the Cannabis Control Authority opens retail and delivery licenses, all commercial delivery in Richmond is unlawful. Richmond Police and the CCA actively enforce against gifting operators advertising on social media. Richmond's medical cannabis program operates under separate state pharmaceutical processor licensing and may deliver to qualified patients under Virginia Code Section 54.1-3442.6.
Gifting cannabis with any associated payment, or running an unlicensed delivery service, can result in misdemeanor or felony charges depending on quantity and prior offenses.
