Michigan's Earned Sick Time Act, MCL 408.961 et seq., took effect February 2025 and applies to all Detroit employers. Workers accrue one hour of paid sick time per 30 hours worked.
Following the 2024 Michigan Supreme Court ruling, the original Earned Sick Time Act took effect statewide in February 2025, codified at MCL 408.961 through 408.973. Detroit employers with 11 or more employees must allow up to 72 hours of paid earned sick time annually; smaller employers must allow 40 paid plus 32 unpaid hours, transitioning over a phase-in. Workers accrue one hour per 30 hours worked and may use leave for personal illness, family care, domestic violence safe leave, or public health emergencies. Michigan preempts local sick-leave rules, so Detroit cannot expand benefits beyond state minimums.
Failure to provide accrual, retaliating against workers for use, or denying eligible leave triggers Michigan LEO complaints, civil fines up to $1,000 per violation, restitution of pay, and damages including reinstatement for retaliation.
