Initiative 436 (Healthy Families and Workplaces Act) requires Nebraska employers with 20+ employees to provide up to 56 hours (seven days) of paid sick leave annually, while employers with fewer than 20 must provide up to 40 hours. Employees accrue one hour per 30 hours worked. Leave covers the worker's illness, family caregiving, domestic violence, and public health emergencies. The Nebraska Department of Labor administers complaints. Lincoln cannot expand or shrink these baseline obligations because the act preempts conflicting local ordinances.
Employers denying accrual, retaliating against use, or failing to post notices face Nebraska Department of Labor enforcement, back pay, civil penalties, and private rights of action with attorney fee shifting.
