Arizona preempts most local paid leave mandates, while requiring statewide earned paid sick time under Proposition 206 and ARS 23-371.
Proposition 206 added ARS 23-371 through 23-381, requiring employers to provide earned paid sick time at one hour per 30 worked, capped at 24 or 40 hours depending on employer size. ARS 23-204 preempts cities from creating different paid leave rules for private employers. Local governments still regulate their own employees. The Industrial Commission of Arizona enforces sick time rules and investigates retaliation, with civil penalties for noncompliance.
Employers denying earned sick time face civil penalties starting at $250 per violation and reinstatement orders for retaliation.
