Atlantic County fronts the Atlantic Ocean along its barrier islands. Under New Jersey's Coastal Area Facility Review Act, N.J.S.A. 13:19-1 et seq., a CAFRA permit from NJDEP is required for development on a beach or dune, within 150 feet of tidal water, and throughout the coastal area.
The barrier-island communities of Atlantic City, Ventnor, Margate, Longport, and Brigantine, and the bay and river frontage of Absecon, Somers Point, and Egg Harbor Township, all sit inside New Jersey's regulated coastal area. Under CAFRA, N.J.S.A. 13:19-5, a state coastal permit is required for any development on a beach or dune, within 150 feet of the mean high water line of tidal waters, and for larger residential, commercial, and public projects farther landward in the coastal area. NJDEP reviews applications under the coastal zone rules of N.J.A.C. 7:7, which limit building on dunes and V-zones and protect tidal wetlands. Docks, bulkheads, and piers on tidal water also require waterfront development approval, and riparian tidelands leases or grants may apply.
Building on a dune, beach, or within the coastal area without a CAFRA permit violates the Act, bringing stop-work orders, mandatory removal, restoration of the dune or wetland, and civil penalties.
