Gloucester County fronts the tidal Delaware River on its west side. Under New Jersey's Waterfront Development Act, N.J.S.A. 12:5-3, no dock, wharf, bulkhead, pier, or other waterfront development on that tidal water may proceed without an NJDEP permit.
Gloucester County has no Atlantic shore, so the Coastal Area Facility Review Act does not apply. But its western edge, West Deptford, Paulsboro, and National Park, sits on the tidal Delaware River, and several creeks, including Mantua, Big Timber, Raccoon, and Oldmans, are tidal near their mouths. The Waterfront Development Act requires that any plan to build or alter a dock, wharf, pier, bulkhead, bridge, pipeline, cable, or similar structure on or adjacent to these tidal waters be submitted to NJDEP and approved before work starts. NJDEP reviews it under the coastal zone rules of N.J.A.C. 7:7, and riparian tidelands leases or grants may also be required.
Constructing a bulkhead, dock, or fill on the tidal Delaware River or a tidal creek without NJDEP waterfront development approval violates the Act, bringing stop-work orders, removal demands, and penalties.
